You are applying for a Dolafy Card. By giving your consent to this Consent Statement for the Program, it applies even if you do not obtain (or are not offered) a Dolafy Card.

Your affirmative consent to this E-Sign & Electronic Communications Notice (the “Consent”) permits AETERNUM CAPITAL LTDA (doing business as Dolafy), together with its issuing bank partner(s) and service providers (“we,” “us,” and “our”) to provide legal disclosures, notices, and other communications (“Covered Items”) to you electronically and to accept your electronic signatures through the Dolafy web dashboard, mobile application, or application programming interfaces (collectively, the “Platform”). If you do not consent to electronic delivery of Covered Items, you will be unable to use the Platform or receive a Dolafy Card. By registering for a Dolafy account, applying for a card, or accessing the Dolafy Dashboard, you agree that such registration constitutes your electronic signature and that you are providing notices and signatures to us electronically in each case as required by law, with the same legal effect as a physical signature. You may always request to receive Covered Items in paper form by following the instructions under “Access to Paper Copies” below.

Your Consent remains effective until (1) you or we terminate the Dolafy Card Program or your Card; or (2) you opt-out of electronic communications. If you terminate your Card, your Consent will continue with respect to rights and obligations that survive termination (including rights created by this Consent Statement).

Methods of Providing Covered Items

“Provide” means deliver, make available, send, notify, or a similar term. Covered Items may be delivered electronically through files (e.g., PDF), links, or downloads from our website or Platform. You are responsible for reviewing Covered Items promptly and taking any required action.

Access to Paper Copies

You may print or save Covered Items using the functionality of the application or browser you are using. We retain copies of Covered Items for time periods required by law and will provide you with copies upon written request within those periods. You may request a paper copy of any Covered Item at no cost by emailing us at support@dolafy.com.

Our Right to Send Paper

Even if you have given us Consent to provide Covered Items electronically, we reserve the right to deliver them in paper form at any time, for example, if we suspect fraud or experience a system outage.

Hardware and Software Requirements

To access and retain Covered Items electronically, you must have:

  • Reliable Internet access;
  • A web browser that supports 128-bit encryption (current versions of Chrome, Firefox, Microsoft Edge, or Safari);
  • 16 MB of available memory (32 MB or more of RAM recommended); and
  • Software that can view, save, and print PDF files (for example, Adobe Reader 4.0 or higher).

By providing your Consent, you confirm you meet these system requirements.

You may withdraw Consent at any time, free of charge, by emailing support@dolafy.com. Withdrawal prior to account approval will prevent you from receiving credit or services over the Internet. Withdrawal does not affect the legal effectiveness, validity, or enforceability of electronic disclosures provided before withdrawal.

Acknowledging Ability to Access and Consenting to Electronic Communications

By confirming that you have read and agreed to this Notice, you acknowledge that (1) you have access to the hardware and software stated above; (2) you agree to receive Covered Items electronically; and (3) you are able to access, save, and print or otherwise store the information presented to you.
