These Terms and Conditions govern your use of eligible debit or credit cards issued by AETERNUM CAPITAL LTDA (doing business as Dolafy) and its issuing partners (each, a “Payment Card”) when you add, attempt to add, or keep a Payment Card in the Apple Pay wallet (“Wallet”) on any iPhone, iPad, Apple Watch, or other Apple device (“Device”) that supports the Wallet. These Terms form an agreement between you and Dolafy regarding the use of your eligible Payment Card with the Apple Pay service.

“You,” “your,” or “user” refer to the cardholder whose name appears on the Payment Card or any authorized user. “Dolafy,” “we,” “our,” or “us” refer to AETERNUM CAPITAL LTDA, a company registered in Brazil under CNPJ 59.983.687/0001-75, and its affiliates. “Dolafy Issuing Partner” refers to any licensed card issuer that works with Dolafy to issue Payment Cards.

Enrolling your Payment Card in Apple Pay constitutes your acceptance of these Terms.

I. Relationship to Apple

Apple Pay is offered exclusively by Apple Inc. Dolafy does not own, operate, or control Apple Pay and is not responsible for any service provided to you by Apple or third parties engaged by Apple. Your use of Apple Pay is also subject to Apple’s terms of service, privacy policy, and any third-party agreements. Apple, Apple Pay, iPhone, iPad, and Apple Watch are trademarks of Apple Inc.

II. Your Payment Card Agreement Remains Unchanged

Adding a Payment Card to Apple Pay does not alter any agreement you have with us. The terms and conditions governing your Payment Card — including fees, interest, rewards, and dispute-resolution procedures — remain in full force and effect and apply to transactions you execute through Apple Pay.

III. Eligibility

Your Payment Card and its underlying account must be in good standing, and you must not be restricted from using Apple Pay by Apple, your wireless provider, payment networks, or other third parties. We may decline, suspend, or revoke Apple Pay eligibility at our discretion if we believe continued use presents risk.

IV. Device Eligibility

You must use an Apple device that Apple designates as eligible for Apple Pay. Devices that have been jail-broken, rooted, or otherwise modified contrary to Apple’s guidelines are ineligible. Attempting to use an ineligible device is a breach of these Terms and may result in suspension or removal of your Payment Card from Apple Pay. V. Fees

Dolafy does not currently charge a fee for using Apple Pay. You remain responsible for any charges assessed by your wireless carrier, Apple, or other parties. We reserve the right to introduce fees related to Apple Pay or related services after providing at least 30 days’ prior notice where permitted by law.

VI. Suspension or Removal of Your Payment Card

We may block, suspend, or cancel your Payment Card in Apple Pay at any time, for any reason including suspected fraud, loss or theft of your Payment Card or Device, or changes in applicable law or network rules.

VII. Electronic Communications

You consent to receive electronic communications — including email, in-app messages, and push notifications — regarding Apple Pay. Keep your contact information current in the Dolafy dashboard or by contacting us.

VIII. Data Privacy

By enrolling your Payment Card in Apple Pay you authorize Dolafy, payment networks, Apple, and service providers to collect, share, transmit, and use data about you and your transactions as necessary to operate Apple Pay, mitigate fraud, and comply with legal obligations. Dolafy’s handling of your data is described in the Dolafy Privacy Policy (available at dolafy.com/legal/privacy). Dolafy does not control Apple’s data-handling practices; refer to Apple’s privacy policy for details.

IX. Transaction Information Disclaimer

Transaction details shown in Apple Pay are for convenience only and may be delayed, incomplete, or inaccurate. Your official transaction record is the entry posted to your Payment Card statement.

X. Indemnification

You agree to indemnify and hold harmless Dolafy, its affiliates, directors, officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of Apple Pay, your breach of these Terms, or your negligence, intentional action or inaction, and/or misconduct.

XI. Your Responsibilities

A. Enrollment

Follow Apple’s and Dolafy’s procedures to add a Payment Card to Apple Pay. We may decline enrollment if we cannot authenticate your Payment Card or detect potential fraud.

B. Lost or Stolen Device or Payment Card

Notify us immediately if your Device or Payment Card is lost, stolen, or compromised so we can suspend or deactivate your Payment Card in Apple Pay. Delayed notice may increase your liability for unauthorized transactions.

C. Security

Maintain the confidentiality of your Apple ID, device passcodes, and biometric credentials. Sharing these credentials may result in unauthorized transactions for which you are responsible.

D. Accurate Information

You warrant that all information you provide to Dolafy and its Issuing Partners in connection with Apple Pay is true, accurate, and complete.

XII. Notices & Changes to These Terms

We may amend these Terms by posting updated terms on our website, emailing you, or notifying you through the Dolafy platform. Changes take effect on the date stated in the notice. Continued use of Apple Pay after that date constitutes acceptance.

XIII. Limitation of Liability; No Warranties

EXCEPT AS REQUIRED BY LAW, DOLAFY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, RELATED TO APPLE PAY. TO THE MAXIMUM EXTENT PERMITTED, DOLAFY WILL NOT BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, ARISING FROM YOUR USE OF APPLE PAY, EVEN IF ADVISED OF THE POSSIBILITY.

XIV. Governing Law

These Terms are governed by the laws of the Federative Republic of Brazil and applicable international law, without regard to conflict-of-law principles. Disputes are subject to the arbitration or dispute-resolution provisions in your Payment Card agreement.
