These Terms and Conditions govern your use of eligible debit or credit cards issued by AETERNUM CAPITAL LTDA (doing business as Dolafy) and its issuing partners (each, a “Payment Card”) when you add, attempt to add, or keep a Payment Card in Google Pay on any phone, tablet, smartwatch, or other mobile device (“Device”) that supports Google Pay.
These Terms are an agreement between you and Dolafy regarding the use of your eligible debit or credit card account with Google Pay. “You,” “your,” or “user” refer to the cardholder whose name is located on the Payment Card or any authorized user of the Payment Card. “Dolafy,” “we,” “our,” or “us” refer to AETERNUM CAPITAL LTDA, a company registered in Brazil under CNPJ 59.983.687/0001-75, and its affiliates. “Dolafy Issuing Partner” refers to any licensed card issuer that works with Dolafy to issue Payment Cards. Enrolling your Payment Card in Google Pay constitutes your acceptance of these Terms.
I. Relationship to Google / Google Terms of Use
Google Pay is a service offered exclusively by Google LLC. Dolafy does not own, operate, or control Google Pay and is not responsible for any service provided to you by Google or by any third party engaged by Google. We likewise are not responsible for any information or other services provided to you by Google or any other third parties associated with Google Pay and are not liable for any failure or performance of Google Pay. Your use of Google Pay is also subject to agreements or terms of use with Google and/or other parties. Google, Google Pay, and associated logos are registered trademarks of Google LLC. These Terms are in addition to those imposed by Google or any third party.
II. Your Dolafy Payment Card Terms Do Not Change
Your enrollment of a Payment Card into Google Pay does not alter any other agreement you have with us. The terms and conditions for your Payment Card provided to you at account opening (as amended from time to time) remain in full force and effect, and all fees, interest, rewards, and other provisions continue to apply to transactions you make using Google Pay. For clarity, any transaction you complete with your enrolled Payment Card through Google Pay will be treated in the same manner as if you had used your physical or virtual Payment Card.
III. Eligibility for Google Pay
To be eligible to add your Dolafy Payment Card to Google Pay, your Payment Card account must be in good standing and you must not otherwise be prohibited from using Google Pay by Google, your wireless service provider, applicable payment networks, or any other third party. We may revoke or suspend your Google Pay eligibility at any time if, in our reasonable discretion, your continued use of Google Pay presents risk to you, us, or any third party.
IV. Device Eligibility
You must use a Device that Google has deemed eligible for Google Pay. Devices that have been modified contrary to the manufacturer’s or Google’s software guidelines (e.g., jail-broken or rooted) are not eligible. Attempting to use an ineligible device constitutes a breach of these Terms and may result in us blocking or removing your Payment Card from Google Pay. Dolafy is not responsible for any resulting loss or damage. A current list of eligible devices is maintained by Google at https://www.android.com/pay/.
V. Fees
Dolafy does not currently charge a fee for using Google Pay. Your Payment Card account agreement governs any applicable card fees. You are responsible for charges assessed by your wireless carrier, Google, or any other third party. We reserve the right to introduce fees for Google Pay enrollment or related services in the future after providing you with at least 30 days’ prior notice, where permitted by law.
VI. Suspension or Removal of Payment Card
We may temporarily or permanently block, suspend, or cancel your Payment Card within Google Pay at any time for any reason including but not limited to suspected fraud, loss or theft of your Payment Card or Device, or changes in applicable law.
VII. Electronic Communications
You consent to receive electronic communications from us — such as emails, in-app messaging, or push notifications — regarding your use of Google Pay. You are responsible for keeping your contact details up to date within the Dolafy dashboard or by contacting us.
VIII. Data Privacy
By enrolling your Payment Card in Google Pay you authorize Dolafy, the applicable payment network(s), Google, and other service providers to collect, share, transmit, and use information about you and your transactions as necessary to provide Google Pay services, prevent fraud, and comply with legal obligations. Use of your information is governed by the Dolafy Privacy Policy (available at dolafy.com/legal/privacy) and Google’s privacy policy. Dolafy has no control over, and is not responsible for, Google’s or any third party’s privacy or security practices.
IX. Transaction Information
Any transaction details displayed within Google Pay are provided for convenience only and may be incomplete, delayed, or otherwise inaccurate. Your official record of any Payment Card transaction is the amount posted to your Payment Card statement.
X. Indemnification
You agree to indemnify, defend, and hold Dolafy, its affiliates, directors, officers, employees, and agents harmless from any and all claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of Google Pay, your violation of these Terms, or your negligence, intentional action or inaction, and/or misconduct.
XI. Your Responsibilities
A. Enrollment
You must follow Google’s and Dolafy’s procedures to add a Payment Card to Google Pay. We may decline enrollment if we cannot authenticate your Payment Card or if we believe enrollment poses risk.
B. Lost or Stolen Device or Payment Card
Notify us immediately if your Device or Payment Card is lost, stolen, or compromised so that we can suspend or deactivate your Payment Card in Google Pay. Delayed notice may result in financial liability to you for unauthorized transactions.
C. Security
You are solely responsible for safeguarding your Device, Google account credentials, device passcodes, and any biometric security features. Sharing these credentials with others is done at your own risk and may result in unauthorized transactions.
D. Accurate Information
You represent and warrant that all information you provide to Dolafy and its Issuing Partners in connection with Google Pay is true, accurate, and complete.
XII. Notices & Changes to These Terms
We may provide notices or changes to these Terms by posting updated terms on our website, emailing you, messaging you through the Dolafy platform, or mailing you at the address on file. Unless a longer notice period is required by law, changes become effective on the date indicated in the notice. Continued use of Google Pay after the effective date constitutes acceptance.
XIII. Limitation of Liability; No Warranties
EXCEPT AS REQUIRED BY APPLICABLE LAW, DOLAFY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, RELATING TO GOOGLE PAY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOLAFY SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, ARISING OUT OF OR RELATING TO YOUR USE OF GOOGLE PAY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
XIV. Governing Law
These Terms are governed by and construed in accordance with the laws of the Federative Republic of Brazil and applicable international law, without regard to its conflict-of-law principles. Any dispute arising out of these Terms shall be resolved in accordance with the dispute-resolution provisions contained in your Payment Card agreement.
